Terms of Service

By accessing or using Antacarte's digital vehicle inspection platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

If you do not agree to these Terms, you may not access or use the Service. We recommend that you print or save a copy of these Terms for your records.

Antacarte provides a digital vehicle inspection platform designed for European trucking companies. Our services include:

• Digital daily vehicle and trailer inspection forms
• Mobile and web-based inspection completion
• PDF report generation and export
• Email delivery of inspection reports to third parties
• Data storage and retention for compliance purposes
• Fleet management tools for managers
• Analytics and reporting dashboards

Internet connectivity is required to access and use the Service. The Service does not currently support offline functionality.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice when possible.

To use our Service, your company must register and create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. Multiple user types may be created: managers who administer the fleet, and drivers who complete inspections.

You must immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account credentials.

Antacarte offers several subscription plans to meet different business needs. All plans are billed on a per-driver basis, where you pay for each active driver who can log in and complete inspections.

Billing is calculated based on the number of active drivers in your company each billing period. Deactivated drivers do not count toward your billing total.

Subscription fees are billed in advance on a monthly or annual basis depending on your chosen plan. All fees are quoted in Euros (EUR) and are exclusive of applicable taxes.

Payment is due upon invoice. We accept major credit cards (Visa, Mastercard, American Express) and bank transfers for annual invoices. Failure to pay may result in suspension of your account.

Refunds are generally not provided for unused portions of a subscription period. However, if you cancel within the first 14 days of a paid subscription, you may request a full refund.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Upload or transmit viruses, malware, or other harmful code
• Share your account credentials with unauthorized users
• Use the Service to store or transmit false or misleading information
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems to access the Service without our permission

The Service and its original content, features, and functionality are owned by Antacarte and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain all rights to the data you input into the Service. By using the Service, you grant us a limited license to process and store your data as necessary to provide the Service.

Your data belongs to you. All inspection reports, vehicle information, driver data, and other content you create or upload remains your property.

You may export your data at any time using the available export features. Upon account termination, you will have a reasonable period to export your data before it is deleted.

Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your data.

You may terminate your account at any time by contacting us. Termination will take effect at the end of your current billing period.

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or engage in fraudulent or illegal activity.

Upon termination, your right to use the Service will immediately cease. We will retain your data for a reasonable period to allow you to export it, after which it will be permanently deleted.

To the maximum extent permitted by law, Antacarte shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Changes will be documented in the Version History section.

Your continued use of the Service after any changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

These Terms shall be governed by and construed in accordance with the laws of the European Union and the member state in which Antacarte is registered. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
